Please read the following terms (“Terms of Use”) carefully before viewing or using the yakovee.com web site (“Site”). By accessing or using the Site you signify that you have read, understand and agree to be bound by these Terms of Use. Yakovee Law, P.A. reserves the right to modify these Terms of Use at any time by posting modified Terms of Use, and your continued use of the Site thereafter will constitute agreement with such modifications. If you do not agree to these Terms of Use, please do not use this Site.

1.  YAKOVEE LAW, P.A.  Yakovee Law, P.A. is a Florida professional association with its principal office in Miami, Florida. References in these Terms of Use or the Site to "Yakovee Law, P.A.," “Yakovee Law” or “YL” refer to the professional association, unless indicated otherwise.

2.  NOT LEGAL ADVICE. The materials on this Site have been prepared by YL for informational purposes only and are not legal advice. This information is not intended to create, and receipt of it does not constitute, an attorney-client relationship. Internet visitors and online readers should not act upon this information without seeking professional counsel. Although YL endeavors to keep this Site current and accurate, the content on the Site may not reflect current legal developments. Yakovee Law expressly disclaims all liability in respect to actions taken or not taken based on the content of this Site.

8.  RULES OF CONDUCT. While using the Site you will comply with all applicable laws, rules, and regulations. In addition, YL expects users of the Site to respect the rights and dignity of others. Your use of the Site is conditioned on your compliance with the rules of conduct set forth in this section; your failure to comply with such rules may result in termination of your access to the Site. You agree that you will not:

a.  Use the Site for any fraudulent or unlawful purpose;

b.  Use the Site to defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others, including without limitation others’ privacy rights or rights of publicity, or harvest or collect personally identifiable information about other users of the Site;

c.  Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Site; or express or imply that YL endorses any statement you make;

d.  Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available; or violate any requirements, procedures, policies, or regulations of such networks;

e.  Transmit or otherwise make available in connection with the Site any virus, worm, Trojan horse, Easter egg, time bomb, spyware, or other computer code, file, or program that is harmful or invasive or that may be or is intended to damage or hijack the operation of, or to monitor the use of, any hardware, software, or equipment; 

f.  Restrict or inhibit any other person from using the Site (including without limitation by hacking or defacing any portion of the Site);

g.  Reproduce, duplicate, copy, sell, resell, or otherwise exploit for any commercial purposes, any portion of, use of, or access to the Site;

l.  Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine,” or in any way gather Site content or reproduce or circumvent the navigational structure or presentation of the Site without the express prior written consent of YL. Notwithstanding the foregoing, YL grants the operators of public online search engines limited permission to use search retrieval applications to reproduce materials from the Site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of such materials solely in connection with each operator’s public online search service. Yakovee Law reserves the right to revoke these exceptions either generally or in specific instances.

9.  CAPACITY TO ACCEPT TERMS. In accessing or using the Site, you affirm that you (a) are more than 18 years old, or an emancipated minor, or possess legal parental or guardian consent, (b) are fully able and competent to understand and enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use and the Site's Privacy Policy, and (c) agree to comply with these Terms of Use and the Site's Privacy Policy. In any case, you acknowledge that the Site is not intended for children under the age of 13, and affirm that you are more than 13 years old. Please do not visit or use the SIte if you are under 13, and talk to your parents or guardian about which websites you can visit. If relevant to you, YL notifies you that parental control protections are commercially available that may assist you in limiting access to material that is harmful to minors. Please note that YL does not endorse any of the products or services listed at these sites.  

10.  LIMITATION OF LIABILITY/SUBJECT TO REVISION. The information on this Site, including these Terms of Use, is subject to change at any time and for any reason without notice. We recommend periodically reviewing the Terms of Use set forth on this page. Your use of this Site is at your own risk. The materials presented on this Site may not reflect the most current legal developments, verdicts, or settlements. In no event shall YL or its attorney(s), other employees, affiliates, or contributors to this Site, be liable for any loss or injury, or any damages, whether direct, special, indirect, punitive, incidental, exemplary, consequential, or otherwise, whether based on breach of contract, tort (including negligence), or otherwise, resulting from your access or use of this site. You hereby waive any and all such claims against YL, its attorney(s), other employees,affiliates and contributors to this Site. You agree that the limitations set forth above are fundamental elements of this agreement, and that the Site and its materials would not be provided to you absent such limitations. Some state statutes may restrict this limitation of liability.

11.  GOVERNING LAW AND FORUM. These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida, United States, without giving effect to any principles of conflicts of law. By using this Site you agree that the State or Federal courts in Orange County, Florida, United States, shall have exclusive jurisdiction and venue to hear any dispute arising out the content or use of this Site, and agree not to bring any action or proceeding in any other venue.
